I PURCHASED MY HOME IN NOVEMBER OF 1997 FOR THE PAST RECENT 3 YEARS I HAVE BEEN CHARGED FROM MY MORTGAGE COMPANY A FEE FOR INSPECTION FEES TOTALING AN AMOUNT OF OVER $1900 I SENT A CERTIFIED LETTER TO THE COMPANY STATING ABOUT THIS CHARGES AND RECEIVED A REPLY WITH A CREDIT FOR $136.55.STATING THAT INSPECTIONS ARE CHARGED ONCE THE ACCOUNT IS LATE OR PAST DUE ?
THE DETAILS OF MY MORTGAGE CONTRACT ARE CLEAR IN STATING THAT INSPECTIONS ARE TO BE PREFORMED WITH LENDER APPROVALS,NOTICE AND PREFORMED. WHICH THIS HAS NEVER HAPPENED. I REQUESTED INFORMATION ON DATE,TIME AND PLACE WHEN THESE INSPECTIONS ARE PREFORMED, WITH NO GIVEN ANSWER. MIDLAND MORTGAGE IS PRESENTING FEE'S AND CHARGES THAT ARE NOT VALID TO CONTRACTS THAT HAVE BEEN OFFICIALLY PROCESSED AFTER 2001 OR 2002.
MY CONTRACT STATES AS FOLLOWS: INSPECTIONS- Lender may make or cause to be made reasonable ENTRIES upon and inspections of the property UPON NOTICE TO THE BORROW specifying reasonable cause therefore related to the interest in the property; PURSUANT TO SECTION 420.513.PAGE 2 PARAGRAPH 8.
