We are starting with a QWR (qualified written request)to Midland Mortgage in July 2011. We hope to proceed with a law suit from there. We are at the end of our rope with Midland Mortgage! This co. has ruined our credit, lied to us over and over and over again, our paper work has been lost several times, and we have sent payments that Midland refuses to apply to our account. Same issues as everyone else on this page- rude customer service, we can't get anything in writing, and the goal of Midland is to absolutely foreclose on as many homes as they can. Anyone out there have MERS on their mortgage title? Pretty good chance you do, if your loan was packaged and sold. I appreciate the non-profit groups that are available to home owners and I have spoke with several or them, including HUD. They mean well, but they can not give legal advise, their employees are over whelmed, most importantly, these groups can not take action against these banks/mortgage companies.

I never thought this mortgage mess would be happening to my family, but it is, but we are not taking it lying down. We have so many rights as home owners! My eyes have really been opened. Good luck to all of us.

Midland mortgage stone cold krocks with a k. my name is edith Cole a widow and a 89 year old elderly woman my house currently went into for closer they put a motion to have my property vac in the mist of that they put my house up for public oction and they bout it for 500 bucks and they now have it on the marget for 78 thousand dollars I need help ?

Good afternoon , I feel the same as you do . They won't help you in any matter .

They find loop holes , they tell you that you don't qualify for anything. They jacked up my house payment $254.00 @month because my property taxes went up. I work for the county government and they have a payment plan . I wanted to go that route .

To bring my house payment back affordable. And was send a letter ( denied. ) They won't work with you. they Told me my escrow account was short $2000.00 I offer to pay a $1000.00 dollars to bring my Payment more manageable.

And was told they couldn't help.

The Banks were bailed out by the tax payer and now they won't help us. William

I have file a lawsuit in Little Rock AR. Against New Day Financial, Midfirst Bank, And Midland Mortgage.

I just found out about this class Action Suit. I'm not a attorney, Like you I'm

trying to Save my home. Midland Mortgage try's to hide under Midfirst Bank. Which by the

way has already been in a law suit, and settle out of court.

Midland Mortgage claim they bought

our mortgage, from New Day Financial, which too has already been in a Law Suit, and settle

out of court. Here is the catch is New Day Financial had the Mortgage. And at the same time Midland Mortgage claim they bought the Mortgage. New Day Financial claim the Government made them refinance there loans and make them good.

We assume that was part of their agreement with settling out of Court. Since Both were claiming ownership we didn't know what to do. We ended up filing bankruptcy and while we were waiting on that. New Day Financial sent us the Warranty Deed.

We reclaim the house. Midfirst Bank claim ownership and file a law suit against us in 2010 we when to court in 2012 they couldn't prove ownership sue us again and went back to court in 2013 with New Day Financials old Mortgage and got a judgement. We lost are house in 2009 after trying to refi and weekly calls. They ruined our credit to as we were forced to file bankruptcy.

we are having trouble for a lot of the same reasons, they haven't reported our payments to the credit reports for 6 years. 2 years ago, They received an insurance check from damage to my home and Midland would not release any funds of the check that they received and wanted to foreclose on our house when their policy states that 1/3 is to be released immediately and wasn't released.

We received all the funds when we finished all the repairs with our own money $30,000 worth (the check was only $8,000). They will not remove our insurance from escrow when we paid it in full. I have a payoff statement and the interest is for July, August and some of September. The date on the payoff statement is 8-16-13.

So I called to find out why the interest for July is on there when the July payment was made, the girls response "Just Because". It took me 30 minutes to get an accurate answer from her which was interest is back dated so your payment doesn't matter when they want to charge you interest. I am refinancing my house and in 2007 Midland post on my credit report that there is a dispute. When I called to get a letter stating that there is no dispute, she said that there is a dispute from July and March of this year.

Now I have to fax a letter and wait 7-10 business days to resolve this when they have put other peoples disputes on to my account. please contact us with your info krist1977@***.net

I am so fed up with MM!! We couldn't afford the payments so asked MM for help.

They sent us paperwork after paperwork and we had to send in miles of forms and statements. We were denied 18 times in a 2yr period! They kept stating to call HUD bc our debt to income ratio was too high. Well......duh!!

We lost our business and struggled to just put food on the table! We finally had our last straw when we sent in a payment thru our coupon book and they called to say it it bounced. What? I called the bank.

We had sufficient funds in our acct!! I called them back and went thru the SAME 5 ppl I talk to EVERY TIME I called!! We decided to formally declare bankruptcy when we became 4mos behind our mortgage. Just walk away and cut our losses.

We were all too stressed to deal with anymore. Our attorney even wrote in the bankruptcy form that we were surrendering the house per our bankruptcy. Guess what?? They STILL have us living there A YEAR AFTER WE LEFT!!

We called the insurance agent to cancel our policies and they couldn't do it unless we received a letter from MM stating that, yes, we surrendered the home for foreclosure. MM had NO CLUE WHAT WAS GOING ON!! I still have the house keys bc NO ONE can tell me where or who to send them to!!!!!!!!! I'm livid.

My husband is livid. My attorney is livid!!!!!!!! What can I do???

They claim we are gonna still owe massive amounts of money from the taxes and the insurance they are paying out of our 'escrow' that we haven't paid into since Feb 2012.

I am a disabled armed forces veteran who was retired from active duty in 2010. My income dropped by 50% while I was waiting for Veteran Administration assistance.

I called Midland and asked for help. They were rude and unhelpful.

I NEVER missed a monthly payment and now they tanked my credit score.

This company is part of the evil that has become part of our American culture. I want to expose them and close shop.

I would also like to be involved with a lawsuit against Midland Mortgage Company. I am in the US Army and the Army transferred me from NC to PA.

I had bought a home in NC and was not able to pay 2 mortgage payments. I worked out a loan modification but Midland did not put the months missed at the end, so every month my credit was showing 90 - 120 days late on my mortgage. Eventually renters moved out the house went into foreclosure. An offer was submitted for a short sale, but it was not enough.

Another offer was submitted but Midland failed to contact myself, my realtor, or anyone else to let us know. I called to check on the postponement of foreclosure a couple of days from the date of foreclosure, and that's when I was told the counteroffer was still too low. The day before foreclosure, my realtor faxed and updated offer 3 times to the fax number Midland gave her. Every time I called Midland, they said they had not received it.

I called back the day of foreclosure and they said they still hadn't received it. Come to find out the fax number they gave my realtor was for the Loss Mitigation department, and not the Delinquency Assistance Center. I called Midland and they just kept saying they hadn't received it even though my realtor had 3 confirmations the fax went through. I have been deployed to Iraq for a total of 27 months but this has been the most stressful time of my life.

Midland acted as if they didn't care, the customer service was consistently horrible, they never communicated when they should have, and now the house has been foreclosed.

Good luck to you with Midland. My son has had all the same problems with them, they have ruined his credit and have made it impossible for him to refinance.

There has to be someone to turn to for help. Please keep us posted.

We r trying to refin now for lower rate and on the pay off they added late fees of 1895.00 3 years off late fee. What a joke then we have a payment history of no late payments. They where not reporting us to credit and all kinds of ***.

To the person that have file a class action law suit against Midland Mortgage good luck. If you can tell how you got started we are going though the same problems with payments not being posted and late fees being charged against our account, and never responding or following up on telephone conversation.

I would also like to get together and collaborate on a lawsuit against this company. They harass, loose paper work, and act as if they aren't liable and will do anything in their power to foreclose your home.
